Terms of Service

1. Preamble

These Terms of Service (hereinafter "ToS") govern the use of the DesignDads platform (hereinafter the "Platform"), accessible at https://designdads.io, published by ECOMTIME AGENCY.

Using the Platform implies full and complete acceptance of these ToS. If you do not accept these terms, please do not use the Platform.

• "Platform" : refers to the DesignDads website and all its features.
• "User" : any natural or legal person using the Platform.
• "Account" : personal space created by the User on the Platform.
• "Credit" : consumption unit allowing visual content generation via AI.
• "Content" : images, visuals, videos generated by AI or uploaded by the User.
• "Subscription" : paid access plan to the Platform (Discovery, Creator, Pro, Agency).

4. Platform Purpose

DesignDads is a SaaS (Software as a Service) platform that allows Users to create professional advertising visual content using generative artificial intelligence.

The Platform offers the following features:

• Generation of advertising images from text descriptions ("From Scratch" mode)
• Enhancement and transformation of images uploaded by the User
• Automatic multi-format resizing
• Video animation of static visuals
• Integrated visual editing
• History and creation management
• HD export (PNG/MP4)

5. Account Creation

5.1 Registration

To use the Platform, the User must create an Account by providing the following information:

• Valid email address
• First and last name
• Secure password

The User guarantees that the information provided is accurate, complete and up to date.

5.2 Account Responsibility

The User is solely responsible for the confidentiality of their login credentials. Any activity performed from their Account is presumed to have been performed by them.

In case of fraudulent or unauthorized use of their Account, the User must immediately inform ECOMTIME AGENCY at contact@designdads.io.

6. Subscriptions and Pricing

6.1 Subscription Plans

The Platform offers four subscription plans:

Prices are shown in euros excluding VAT. Applicable VAT will be added at invoicing.

6.2 Payment

Payments are securely managed by our provider Stripe Payments Europe, Ltd.

Paid subscriptions are billed monthly and automatically renewed until cancelled by the User.

6.3 Credit Rollover

Unused credits are carried over according to each plan's terms: no rollover for Discovery and Starter, 3 months for Creator, 1 year for Agency. Expired credits are permanently lost.

8. Termination and Account Deletion

8.1 Termination by User

The User may cancel their subscription at any time from their personal space. Cancellation takes effect at the end of the current billing period, without pro-rata refund.

8.2 Account Deletion

The User may request permanent deletion of their Account by contacting contact@designdads.io.

Deletion results in the immediate and permanent deletion of all personal data and content associated with the Account, in accordance with GDPR. This action is irreversible.

8.3 Termination by ECOMTIME AGENCY

ECOMTIME AGENCY reserves the right to suspend or terminate any Account in case of:

• Non-compliance with these ToS
• Non-payment of a subscription
• Fraudulent or abusive use of the Platform
• Infringement of third-party rights or public order

9. Intellectual Property

9.1 Platform Ownership

The Platform, its source code, structure, databases, design and all elements comprising it are the exclusive property of ECOMTIME AGENCY and are protected by copyright and database rights.

9.2 AI-Generated Content

License granted to ECOMTIME AGENCY: By using the Platform, the User grants ECOMTIME AGENCY a worldwide, non-exclusive, free and perpetual license to use, reproduce and analyze generated content solely for the purpose of improving AI models and Platform features.

ECOMTIME AGENCY commits to never resell, publicly distribute or commercially use content generated by Users without their express consent.

9.3 User-Uploaded Content

The User guarantees having all necessary rights to images and content they upload to the Platform. They specifically guarantee:

• Being the copyright holder or having necessary authorizations
• Not infringing third-party rights (image rights, copyright, trademarks, etc.)
• Not uploading illegal, defamatory or content contrary to public order

The User is solely responsible for content they upload and will indemnify ECOMTIME AGENCY for any third-party claims or actions in this regard.

10. Acceptable Use

Any breach of these rules will result in immediate Account suspension and may lead to legal prosecution.

11. Limitation of Liability

11.1 Service Availability

ECOMTIME AGENCY strives to maintain the Platform accessible 24/7, but does not guarantee any minimum availability. The Platform may be interrupted for maintenance, updates or force majeure.

11.2 AI Generation Quality

Results generated by artificial intelligence are provided "as is". ECOMTIME AGENCY does not guarantee that generated visuals will perfectly match User expectations. Quality depends on many factors (instructions, AI models, etc.).

11.3 Use of Creations

The User is solely responsible for their use of generated content. ECOMTIME AGENCY cannot be held liable for:

• Commercial or public use of creations
• Damage caused to third parties by generated content
• User's non-compliance with third-party rights or applicable legislation

11.4 Limitation of Damages

In any case, ECOMTIME AGENCY's liability is limited to the amounts actually paid by the User during the 12 months preceding the event giving rise to liability.

12. Personal Data

Processing of Users' personal data is detailed in our Privacy Policy, compliant with the General Data Protection Regulation (GDPR).

Data collected includes: email, first name, last name, payment data (via Stripe), creation history, uploaded images, connection logs.

13. Cookies

The Platform uses cookies for proper functioning and to improve user experience. For more information, see our Cookie Policy.

14. ToS Modifications

ECOMTIME AGENCY reserves the right to modify these ToS at any time. Modifications take effect upon publication on the Platform.

Users are invited to regularly consult the ToS. Continued use of the Platform after modification constitutes acceptance of the new ToS.

15. Applicable Law and Jurisdiction

These ToS are governed by French law.

In case of dispute, the User may attempt to resolve the matter amicably by contacting contact@designdads.io.

Failing amicable resolution, any dispute relating to the interpretation or execution hereof shall be brought before the competent courts of ECOMTIME AGENCY's registered office (Toulouse, France), unless mandatory public policy provisions apply.
